More Hiring Restrictions for Employers from the Ohio House

Employers: Have you heard about the Ohio Houses House Bill 187? Its proposal is to protect the privacy of employment applicants; however, it could also make the hiring just a little bit trickier you. House Bill 187: According to 2017 BARNES THORNBURG LLP, House Bill 187 provides that no employer may request an applicants Social Security Number, date of birth, or drivers license number before making an offer of employment. The Problem: You might already see why this new bill could be frustrating for employers. These are the key pieces of information employers and Consumer Reporting Agencies (CRAs) use to check criminal records, driving history, credit history, previous employment, and more. The bill does state that an employer may obtain information for these background screening reasons, but this is unrealistic because it forbids employers from providing this information to third parties, like us. The FCRA (Fair Credit Reporting Act) is a federal law that regulates how Consumer Reporting Agencies (CRA) use consumers information. The Act compels employers to ensure the information they gather and distribute is a fair and accurate summary of a consumers credit history. The law isintendedto protect consumers from misinformation being used against them. As a standard, whenever employers use a third party (like Pre-Check) to conduct background checks on either applicants or employees, the FCRA will apply. The FCRA governs how employers both obtain and handle consumer reports, including a regular background check. Furthermore, and FCRA consumer report is defined as any written, oral or other communication of any information by a CRA bearing on a consumers credit worthiness, credit standing, credit capacity, character, general reputation, personal characteristics or mode of living by the Federal Trade Commission (FTC). New Recreational Marijuana Laws: What You Need to Know

In recent events, recreational Marijuana laws are changing despite harsher federal laws put back into place or introduced by Jefferson Sessions, Attorney General. Sessions has reintroduced mandatory minimums, directing federal prosecutors to give the most severe penalties possible for crimes, including those that are drug-related. Furthermore, tougher sentences will be given to those growing, selling, or smoking Marijuana, which is a part of The Task Force on Crime Reductions and Public Safetys reassessment report of federal Marijuana policies. Minimum Wage to Rise in 21 States - Including Ohio - in 2017

This blog was written by Fox 8 News: Come the new year, millions of the lowest-wage workers across the country will get a raise. Some of those raises will be very minor a cost of living adjustment amounting to an extra nickel or dime an hour. But in several places the jump will be between $1 and $2 an hour. Even that may not sound like a lot, but it can provide a full-time worker with another $40 to $80 a week. That money, in turn, can make it easier to pay for essential expenses, such as groceries, commuting and keeping the lights on. All told, the minimum wage is set to rise in 21 states, at least 22 cities, four counties and one region. The majority of those increases will take place on Jan. 1, but in Maryland, Oregon and Washington, D.C., they go into effect in July. Meanwhile, the state of New York will be bumping up minimum pay on New Years Eve of this year. Ohio and the Legalization of Marijuana: What Employers Need to Know

Recently on June 8th, Ohio passed legislation legalizing the use of medicinal marijuana, becoming the 25th state to do so. This law became effective on September 6th. Physicians are now able to recommend medicinal marijuana to individuals diagnosed with a number of qualifying conditions and diseases, including Alzheimers Disease, Crohns Disease, Cancer, Glaucoma, and Tourettes Syndrome. Though the use of medical marijuana is now legal, the smoking of marijuana is still prohibited. Qualified users may consume marijuana by edibles, vaporizers, tinctures, patches, plant materials, and oils. Marijuana cultivators, processors, dispensaries, laboratories, and registration of physicians all must have state licensure. For the Department of Justice, the legalization of medical marijuana means that they will no longer attempt to prosecute medicinal marijuana distributors or challenge state laws.
